Terms & Conditions

Website Use Clause

1. Scope and Acceptance

These terms and conditions apply to the website operated by Hubert Pawel Kuca (the "Website") and to its design and content, including graphics, artwork, images, the so-called "look and feel", photography, audio and video materials, job postings, software, data, and any other information that may be added to the Website from time to time (the "Content"). By visiting and using the Website or its Content, you agree to be bound by these terms. These terms may be amended from time to time without notice, and each time you visit the Website the version then in force applies to you. If you do not agree with these terms, do not access or use the Website or its Content.

2. Agreement and Restrictions

By using the Website or its Content, you unconditionally agree to comply with and be bound by these terms. Even where you only make partial use of the Website, your use remains subject to this agreement. We may modify, suspend, or discontinue the Website or any of its Content at any time without separate notice.

3. Content Ownership and Permitted Use

Except to the extent necessary to access the Website, you may not copy, publish, transmit, distribute, display, modify, create derivative works from, sell, or otherwise use the Website or its Content, in whole or in part, in any way. The Content is protected by applicable intellectual property laws, including copyright law and international treaties, trademark law, and trade dress and other exclusive rights. All rights not expressly granted to you are reserved. The Content is provided for reference only and should not be treated as accurate, current, or suitable for any particular purpose. Prices shown on the Website are for reference only and do not constitute an offer to you.

4. Third-Party Links

We do not verify or guarantee the accuracy of content, information, or materials on any third-party website linked from the Website. These links are provided for convenience only, and you access them at your own risk. Once you follow such a link, you leave the Website and our terms and policies no longer apply.

5. User Content

When you publish or distribute comments, messages, data, text, music, sound, photos, graphics, or other content to the Website ("User Content") — other than information submitted for employment opportunities, which we process in accordance with our Privacy Policy — you grant us and our designees a worldwide, non-exclusive, transferable, irrevocable right to use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from, and publicly display or perform the User Content. You also grant us and our sub-licensees the right to use your name in connection with the User Content where we choose to do so.

You represent and warrant that: (i) you own or control the rights in the User Content you publish or distribute, or you hold the lawful right to publish and distribute it through the Website; (ii) the User Content is accurate and not misleading; and (iii) publishing or transmitting the User Content does not breach these terms and will not infringe the rights of, or cause harm to, any person or entity.

User Content is treated as non-confidential, and we have no obligation to treat it as confidential. Without limiting the above, we may delete, edit, modify, reject, or decline to publish User Content at our discretion. We have no obligation to pay you or any author for User Content. If you hold moral rights (including rights of attribution or integrity) in the User Content, you agree: (a) not to require any personal identification in connection with the User Content or its derivative works; (b) to permit us and our agents to publish, use, modify, and delete the User Content; and (c) to waive any claim to authorship of the User Content.

6. Prohibited Uses

You agree not to use the Website or its Content for any unlawful purpose or in any way prohibited by these terms. You must not share your login details or passwords with anyone, or use the Website in any manner that could disable, damage, overload, or interfere with its use by others. You must not misrepresent your identity or submit false, misleading, or inaccurate information. You agree not to collect email addresses or other contact details from the Website or use them to send spam. You must not reverse-engineer any aspect of the Website or use robots, spiders, crawlers, scrapers, or other automated means or interfaces not provided by us to access or extract data. You agree not to frame the Website or otherwise create the impression that you have a relationship with us or that we endorse you.

We reserve the right, in our sole and absolute discretion, to refuse service, terminate accounts, and/or cancel orders for any reason, including where we believe your use of the Website breaches these terms, violates applicable law, or harms the interests of Hubert Pawel Kuca.

7. Disclaimer and Limitation of Liability

The Website and its Content are provided for general reference on an "as is" and "as available" basis, without warranties or conditions of any kind. You use the Website and its Content at your own risk. We make no representations, warranties, or conditions regarding their quality, accuracy, reliability, completeness, currency, or timeliness, and we accept no responsibility for any errors, omissions, or inaccuracies in them.

To the fullest extent permitted by law, we disclaim all express, implied, and indirect warranties, representations, and conditions, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty that the Content is error-free or that access will be uninterrupted.

To the fullest extent permitted by law, we will not be liable, whether in warranty, contract, tort, negligence, strict liability, or under any other legal theory, for any damages arising from or connected with your use of, or inability to use, the Website or its Content, including direct, indirect, incidental, consequential, special, punitive, or exemplary damages, lost profits, lost use, lost data, personal injury, fines, fees, or other liability, even if we were advised of the possibility of such damages.

Some laws do not permit the limitation of implied warranties or the exclusion or restriction of certain damages. Where such laws apply, some or all of the above may not apply to you, and you may have additional rights.

8. Indemnity

You agree to defend, indemnify, and hold harmless Hubert Pawel Kuca, its subsidiaries, and their respective managers, directors, agents, and employees from and against all losses, litigation, claims, damages, costs, and expenses (including reasonable legal fees) arising from or related to your use of the Website or its Content, including any User Content you submit. This clause survives termination of this agreement and remains fully effective.

9. Privacy

Please review our Privacy Policy, whose terms are incorporated into this agreement by reference and apply to your use of the Website. Personal information you submit to us through the Website is used in accordance with that policy.

10. Monitoring

We may monitor and review information sent or received through the Website or related emails from time to time. We may review, edit, delete, or block the transmission or receipt of any information that we decide, in our sole discretion, violates these terms. During monitoring, information may be checked, recorded, or copied, and your use of the Website constitutes consent to such monitoring. We are not responsible for content you post or submit.

11. General Provisions

This agreement, together with the agreements and policies referenced in it, is the entire agreement between you and us on the matters it covers and supersedes all prior agreements and representations. If any provision is held unenforceable for any reason, it will be modified only to the minimum extent necessary to make it enforceable, and the remaining provisions continue in full effect. Our failure to take action against a breach is not a waiver and does not limit our rights regarding that or any later breach.

We may transfer our rights and obligations under this agreement to any party at any time without notice to you. This agreement is governed by and construed in accordance with the laws of the Republic of Poland, without prejudice to any mandatory consumer protection provisions of the law of your country of habitual residence.

Sales Terms and Conditions

1. Scope

These sales terms and conditions apply to the online store at www.vostric.com and to all orders and purchases of products ("Products") made through it. These terms may change from time to time, and by placing an order you agree to be bound by the version in force at that time. Placing an order means you accept these sales terms and conditions whether or not you have read them. If you do not agree, do not continue with your order. Please print and keep a copy for your records.

2. Ordering Process

To buy Products from the online store, you must provide a valid delivery address; certain addresses, including post office boxes and freight forwarders, may not qualify. You must supply your name, address, telephone number, email address, payment details, and any other information we request, and you must hold a valid payment method. You must be at least 18 years old. Creating an account is optional; if you do, we may use your saved details to pre-fill billing and delivery addresses for future orders.

You agree not to share your login credentials or passwords and not to use the Website in a way that could disable, damage, overload, or interfere with others. You must not misrepresent your identity. When placing an order, please make sure the Products suit your intended use. Product information on the online store is provided for reference, and we make no representation or warranty that any Product is suitable or compatible for any particular purpose.

3. Prices

Prices are confirmed when you complete checkout. The purchase price is quoted in the currency displayed on the Website, plus any applicable shipping and handling fees and estimated taxes. Your chosen payment method will be charged the displayed purchase price plus shipping costs and applicable taxes. If a price is incorrect due to a pricing error, we may refuse or cancel the affected order and will notify you. Please note that the price in your shopping bag reflects the current product-page price, which may differ from the price shown when you first added the item.

4. Acceptance, Refusal, and Cancellation of Orders

Submitting an order means you agree to purchase the listed Products under these terms. After we receive and accept your order, we will email an order confirmation containing your order number and the Products ordered. Your order is accepted, and a sales contract is formed, only when you receive our order confirmation email. Until then, we may decline your order. We may also cancel any order before delivery, whether before or after acceptance, and will send a cancellation notice to your email address. If we cancel, we are not obliged to fulfil the order and you are not obliged to pay for it.

We will charge the amount set out in the order confirmation only after the Products have shipped, and we will not ship before your card issuer authorises payment. Keep your order confirmation email as proof of purchase. We retain legal ownership of the Products until full payment is received. If our delivery service reports a failed delivery, or if you supplied an incorrect delivery address so the parcel is returned to us, we may treat the order as cancelled. In that case, we will refund the price of the returned Products after receiving them, less any processing fees, shipping costs, and reasonable additional expenses incurred by Hubert Pawel Kuca.

5. Product Supply and Description

We may change, suspend, or discontinue a product before or after accepting an order, without liability or notice. Some products may be unavailable even when shown as in stock, and adding an item to your cart does not guarantee availability. Prices may change without notice; price increases apply to later purchases. Listed prices exclude taxes, shipping, and handling fees, which are added at checkout. Although we try to display product colours accurately, the colours you see depend on your display and may not be exact.

6. Quantity Limits and Resale Restrictions

We may limit the quantity of Products purchased, including limits per person, per household, per payment card, or per order. These limits may apply across orders using the same account, the same payment card, or the same billing and/or delivery addresses. Where a limit applies, we will try to notify you of any cancellation or refusal. We may also restrict or prohibit orders that, in our judgment, come from dealers, resellers, or distributors, or are placed for resale. The online store sells to end users only; Products may not be purchased by dealers, resellers, or distributors or for business purposes. For these terms, "resale" means purchasing or intending to purchase Products from Hubert Pawel Kuca with the purpose of selling them to a third party.

7. Return Policy

We accept returns of unwashed, unworn, or defective Products when our return instructions are followed. Products must include their original labels, manuals, and any free gifts included in the original packaging. Shoes must also be returned complete with both laces, dust bags, and the original boxes. With the original receipt, you may return Products within 30 days of the order date for a full refund to the original payment method. Original shipping costs are final and non-refundable.

Return instructions: contact us to begin a return. We will ask a few questions and then issue a return authorisation number ("RMA") with return shipping instructions. Products cannot be returned without a valid RMA. Pack the Products and send them to us using the return method we provide, quoting your RMA number. The return parcel must be postmarked within 30 days of the order date. Once received, please allow at least 5-7 business days for processing (longer during holidays). If you do not follow the return conditions, we may refuse the return or refund, or deduct reasonable repair or similar direct costs from the refund.

8. Personal Information

Our Privacy Policy and the additional clauses in these sales terms govern how we may collect, use, or disclose personal information. Buying from the online store requires you to accept our Privacy Policy and to consent to the collection, use, and disclosure of personal information described in it.

9. Responsibility

We aim to keep the Website as accurate as possible, but we do not guarantee that any product, service, description, photo, price, or other information is accurate, complete, reliable, current, or error-free. If an error occurs — on the Website, in an order confirmation, in order processing, or in the delivery of products or services — we may correct it (including the price) or cancel the order and refund any amount charged. If such an error occurs, your only remedy is cancellation and refund.

These sales terms set out the entire obligations and responsibilities regarding the Products. To the extent permitted by applicable law, no other warranties, conditions, or terms apply except those expressly described here. In particular, we are not responsible for ensuring that a Product is suitable for you. To the fullest extent permitted by law, we are not liable — whether in warranty, contract, tort, negligence, strict liability, or under any other legal theory — for any damages arising from your use of the Products, the Website, or any content on it, including direct, indirect, incidental, consequential, special, or punitive damages, lost profits, lost use, lost data, personal injury, fines, fees, or other liability, even if advised of the possibility. Some laws do not permit limiting implied warranties or excluding or restricting certain damages; where applicable, some or all of the above may not apply to you and you may have additional rights.

10. Acknowledgement

You confirm that you have read and understood the Website use terms and privacy policies of Hubert Pawel Kuca.

Advertising, Marketing, and Analytics

1. Email Marketing

Our email marketing may include press releases and information about us, our Website, our products and services, events we may hold, and discounts and promotions offered from time to time. Marketing may be personalised (tailored to you based on our understanding of your interests) or non-personalised. Where required by law, we will obtain your consent before sending marketing emails, and you may opt out at any time.

2. Behavioural Advertising

We and our third-party partners may use personal data and other data collected through our Website and third-party services to show you personalised advertisements and to analyse their effectiveness. "Personalised advertisements" are ads for products and services that we think may interest you, based on your activity on our Website and your browsing habits. Third-party partners may also use data they collect to display personalised ads for their own products and services.

These partners may place and access their own cookies, tags, web beacons, or similar technologies on the device you use to access the Website, to deliver interest-based advertising or other content. They may also use information about your visits to other websites to advertise the products and services offered by Hubert Pawel Kuca.

You can set your browser to refuse cookies, as described in the Cookies section. Even then, you may still see online advertising, though it may be less personalised.

3. Social Media Audiences

Where we advertise on social media and other platforms, we may share your email address (usually in encrypted or hashed form) with third-party advertising partners or social platforms such as Facebook, Google, and similar services ("Social Platforms"), so they can try to match our data against their registered users. This may involve providing hashed email lists to Social Platforms or integrating their pixels into our Website, allowing them to identify common factors between our data and data collected through cookies or pixels. For example, we may integrate a Facebook pixel and share your email address with Facebook to build a "custom audience". Where a match succeeds, you may see our ads when you use the Social Platform (for example, in your Facebook feed).

We may also share your personal data with Social Platforms so they can identify other registered users with similar interests and characteristics, and show our ads to those "lookalike" audiences. These activities are also subject to your privacy choices within those third-party services. In some cases, a Social Platform acts as a controller of personal data collected when you use its social media page and may use it independently; please refer to that platform's privacy policy for details and for how to request deletion.

You can also control how your personal information is used for advertising by visiting lorenmark.com.

4. Measurement

We use tools provided by Social Platforms and other advertising partners to deliver and measure advertising in different ways, including search management platforms, analytics services that help us understand how you interact with our services (including on Social Platforms), tools that tell us whether you purchased a product after seeing an ad, and tools that serve ads when you search on Social Platforms or other third-party websites. Besides your email address, these activities may involve transaction data shared with Social Platforms and other advertising partners. Please refer to our cookies section for details on the partners we use.

5. Data Transfers

We may transfer information to other parties across national borders, from your country or jurisdiction to other countries, in accordance with this policy. Your personal information may be transmitted to, stored on, and/or processed on servers in other countries. By using the Website or providing information to us, you agree to the transmission, processing, use, sharing, and storage of your information in other regions. Data protection laws in other regions may differ from those in your region. Where personal data is transferred outside the European Economic Area (EEA), we take reasonable steps to ensure that appropriate safeguards, such as standard contractual clauses adopted by the European Commission, are in place in accordance with applicable data protection law.
